MISSION

Making the Law Office the model department in implementing and enforcing the law, policies and the current regulations for the benefit of the Council and the city community.

VISION

Improving the awareness amongst Ipoh city community in abiding the law. Improving the overall understanding and the national law implementation.

LAW OFFICE OBJECTIVES

This office is responsible in presenting the by-laws to the Council as well as implementing and determining all legal aspects set by Ipoh City Council and their full implementation.

FUNCTIONS

  1. Giving advice, opinion and views to the other departments within the Council relating to all legal aspects.
  2. Handling all litigation matters for all offences under enforceable laws and making civil claims on any person who owes/has arrears with Ipoh City Council.
  3. Preparing the relevant legal documents such as contracts and agreement letters.
  4. Drafting notices, warrants and relevant orders that relate to enforcement tasks.
  5. Drafting, amending, reviewing and re-interpreting all laws and orders applied and enforced by the Council, and drafting new by-laws/orders as well as the amendments.               

    DEPARTMENTAL MAIN FUNCTIONS
    Law Division

  • Giving accurate advice and legal service to the involved department so that actions taken are not in "ultra vires" with existing laws.
  • Responsible in preparing, drafting and reviewing the drafts of By-Laws, Orders, Circular as well as the Procedures, both new and the amendments.
  • Preparing and reviewing various draft agreements and required legal notice.
  • Handling summons files, report and charge papers for registration of litigation cases in Court.
  • Responsible in perusing, hearing and prosecution for Council's cases.
  • Handling matters relating to defence claim, civil actions together with the Council's lawyers panel.
  • Enforcing the laws applicable by the Council and responsible agencies in carrying out enforcement operations.
  • Issuing warning notice to those who fail to pay the required compound within the stipulated time.
  • Providing and assisting the investigating officers in preparing the investigation papers for the litigation cases.
  • Assisting the Valuation Department in seizing tenant's assets who have rental arrears.
  • Assisting other departments in the Council in seizing the tenants' assets for rented shop or premises who fail to pay rental arrears.
  • Assisting the Valuation Department for enforcement actions of Commissioner of Building.
  • Giving awareness to the public to respect the laws  and regulations applied by the Council by means of advisory service.           

ACTIVITIES OF THE MAIN FUNCTIONS

Law Division
Giving accurate advice and legal service to the involved department so that actions taken are not in "ultra vires" with existing laws.

  • Receiving the relevant facts from the Council or the involved Department.
  • Giving advisory service based on the prescribed laws.

    Responsible in preparing, drafting and reviewing the drafts of By-Laws, Orders and Procedures, both new or amendment.

  • Full Meeting as the legislator of By-Laws, Orders, procedures and Regulations.
  • Submission to the State Legislator Office for review.
  • Submission to the State Government Secretary Office (Local Government Division) to be brought up to MMKN for endorsement.
  • Revert to the State Legal Advisor Office to be gazetted.
  • Gazetted by Percetakan Nasional Berhad.

Preparing and reviewing various draft agreements and ‘required legal notice.

  • Must have a "win-win situation" for both parties..
  • Based on the legal provisions.
  • Based on the agreement principles.

Handling summons files, report and charge papers for registration of prosecution cases in Court:

  • Summon papers, charges and reports.

Responsible in perusing, hearing and prosecution for Council's cases. Activities:

  • Prosecuting Officer must obtain the power from AAG under Section 377 (b) Criminal Procedure Code.
  • Any matters relevant to prosecution must be approved by the AAG.
  • To the court for case mentioning or trial..

Handling matters relating to defence claim, civil actions together with the Council's lawyers panel:

  • Review the relevant party's summons.
  • Panel lawyers.
  • Relevant case information.

BACKGROUND

Ipoh City Council's Law Office was established in 1983 and was previously known as Law Division, headed by the Head Assistant Secretary (Law) and was parked under Law and Enforcement Department. The Law Office is now under the Mayor's Office, headed by a Legal Officer and has 11 staff, who are:-

  • 5 Assistant Administrator Clerical / Operational (N17)
  • 1 Junior Assistant Administrator – Typist (N11)
  • 1 Office General Assistant (N4)

STRATEGY

Educating the public to value the law and taking more effective actions such as follows:-
 

  • Initiative in drafting new By-Laws.
  • Developing agreement documents related to contracts.
  • Implementing enforcement action by means of advice, warning, compound, confiscation and others.
  • Ensuring the compound reduction is made after a fair and reasonable consideration.

LAW OFFICE CLIENT CHARTER

As the staff of Ipoh City Council Law Office, we will give a friendly, efficient, honest and quality service in carrying out the Departmental functions and towards making Ipoh City Council an excellent organisational. Thus, we promise to:-
 

  1. Giving accurate legal information
  2. Giving legal advice and views to Ipoh City Council internal departments, outside agencies and the public within 5 days from the date they are received, if not involving other agencies/departments
  3. Preparing contract agreement draft within 14 days the instruction is received.
  4. Guaranteeing that the fine for the compound is reasonable and fair.
  5. Ensuring safekeeping of all legal documents and documents related to court cases in the office.
  6. Preparing report papers, prosecutions, and summons and filing the cases within 7 days from the date the complete is received.
  7. Processing the files received from other departments of the Council for court actions immediately.
  8. Ensuring that civil litigations actions by and to Ipoh City Council is handled by skilful and experienced Lawyers Panel especially related to Local Government laws.
  9. Reviewing and updating the law every 5 years.
  10. Informing the cases' decisions to the relevant departments within 5 days they are received.
  11. All reports will be taken within 1 week.
  12. Always ensuring that Ipoh City Council's image and the public interests are always protected in all aspects whenever actions are taken by the office.
  13. Discussing fairly all out-of-court cases for civil litigation cases in aiming for reducing the costs on both sides.
  14. Giving priority to cases that need to be filed within a statutorily stipulated time period such as cases under Food Act 1983.
